The Framework
Eight Layers of Asset Protection
No single document, trust, or strategy can protect everything you've built. Jim Fletcher's Eight Layers framework is a coordinated, comprehensive system — each layer reinforcing the next — designed to make your wealth genuinely difficult to reach.
Why Layers Matter
A Single Wall Is Not a Fortress.
Most people who think they have asset protection have one thing: an LLC, a will, or an umbrella insurance policy. Each of those is useful. None of them, alone, is sufficient. A determined plaintiff's attorney will find the gap — and exploit it.
The principle behind Jim's framework is simple: every layer you add increases the cost, complexity, and uncertainty of attacking your wealth. At some point, the math stops working for the creditor. That is the goal — not invincibility, but making you the wrong target.
The eight layers are not a checklist to complete in order. They are a system to be designed together, calibrated to your specific risk profile, and maintained over time as your circumstances change.
The Layers
A System, Not a Checklist.
Risk Management
The first layer of any serious protection plan is identifying and managing risk before it becomes a legal threat. This means understanding your specific exposure — your profession, your business activities, your real estate holdings, your personal circumstances — and taking deliberate steps to reduce the likelihood of a claim arising in the first place. Risk management includes operational practices, contractual protections, proper documentation, and the ongoing discipline of running your affairs in a way that minimizes vulnerability. No legal structure can substitute for sound risk management at the foundation.
Insurance
Insurance is the second line of defense — and the most frequently underutilized. A coordinated insurance strategy includes not just adequate malpractice or general liability coverage, but umbrella policies, excess liability coverage, and specialized products such as Directors & Officers insurance. The goal is to ensure that most claims are resolved at the insurance level, before they ever threaten the underlying asset structure. Jim works alongside your existing advisors to identify gaps and ensure coverage is properly coordinated with the rest of your plan.
Corporate Structures
The proper formation and ongoing maintenance of legal entities — LLCs, corporations, limited partnerships — creates a legal barrier between your personal assets and the liabilities of your business activities. Sophisticated structuring involves multi-layered architectures: holding companies, operating companies, and series LLCs designed to create charging order protection and operational separation across multiple assets. An entity that is improperly formed, inadequately capitalized, or carelessly maintained can be pierced by a court. Jim ensures every entity in your structure is built and operated to withstand scrutiny.
Government Exemptions
Federal and state law provide a range of statutory exemptions that shield certain assets from creditor claims — and maximizing these exemptions is a legitimate and powerful protection strategy. Qualified retirement accounts (401(k)s, IRAs, defined benefit plans) carry significant statutory protection under federal and state law. Many states also provide homestead exemptions that protect primary residence equity, with some states like Florida and Texas offering unlimited protection. Understanding and optimizing your exemption position is a foundational step in any comprehensive plan.
Foundational Estate Planning
Asset protection and estate planning are not separate disciplines — they are two dimensions of the same problem. Foundational estate planning includes wills, revocable trusts, durable powers of attorney, healthcare directives, and beneficiary designations. These documents ensure that your wealth transfers according to your wishes, that someone you trust can act on your behalf if you are incapacitated, and that your family is protected during the transition. A plan that protects your wealth during your lifetime but fails to transfer it efficiently at death is incomplete.
Advanced Strategies
For clients with significant estates, advanced planning strategies provide both asset protection and tax efficiency. These include Spousal Lifetime Access Trusts (SLATs), Intentionally Defective Grantor Trusts (IDGTs), Grantor Retained Annuity Trusts (GRATs), Qualified Personal Residence Trusts (QPRTs), Private Placement Life Insurance (PPLI), dynasty trusts, and charitable planning vehicles. With the 2026 basic exclusion at $15 million per person — and potentially $30 million available for a married couple through portability — the window for strategic wealth transfer is significant. These structures require careful design and ongoing maintenance.
Domestic Asset Protection Trusts
Domestic Asset Protection Trusts (DAPTs) — available in select states including Nevada, South Dakota, and Delaware — are frequently marketed as a domestic alternative to offshore planning. Jim discusses these structures with clients specifically to address their significant limitations: DAPTs are subject to U.S. court jurisdiction, vulnerable to fraudulent transfer challenges, and have a mixed track record when tested in litigation. For clients who need serious creditor protection, Jim typically recommends alternatives that provide more reliable results. Understanding what DAPTs cannot do is as important as understanding what they can.
Offshore Asset Protection Trusts
For clients with significant exposure, offshore trusts — particularly Cook Islands and Nevis trusts — represent the most powerful asset protection tools available under current law. Assets held in a properly structured offshore trust are extraordinarily difficult for a domestic creditor to reach: foreign trustees are not subject to U.S. court orders, and the legal and logistical barriers to collection are substantial. These structures are fully legal, require disclosure to the IRS, and are designed for long-term wealth preservation rather than concealment. The offshore layer is the capstone of a comprehensive protection plan.
